Florida court awards $300 million damages to ex smoker
Turkmenistan News.Net Friday 20th November, 2009
Tobacco company Philip Morris has been ordered by a Florida jury to pay an ex-smoker a total of $300 million in compensation.
The former smoker, 61-year old Cindy Naugle has emphysema, a disease commonly linked to smoking. She attended court in a wheelchair.
The jury in Broward Circuit Court awarded Naugle $56 million for medical expenses, and $244 in punitive damages. Punitive damages are designed to punish a defendant.
Philip Morris objected to the jury’s decision saying it followed a trial which incorporated a number of “erroneous rulings,” by the presiding judge.
In a statement issued after the verdict, Murray Garnick, acting for Philip Morris, took particular issue with the amount of punitive damages. "We believe that the punitive damages award is grossly excessive and a clear violation of constitutional and state law," he said.
The Philip Morris statement said the company is reviewing the verdict.
Philip Morris, founded in New York in 1902, is the largest cigarette manufacturer in the United States, dominating almost 50% of the market. The company's brands include Marlboro, Alpine, Benson & Hedges, Philip Morris, Bristol, Cambridge, Chesterfield, Commander, Parliament, Players, Saratoga and Virginia Slims. Ex smoker awarded $300 million damages
What’s wrong with this amount is the fact that by awarding this extremely high amount, no one else will be able to seek damages due to to pot being emptied, this person doesn’t need or deserve this amount, and in receiving it others will have to forget about legal action.

Who's to blame?
Our government subsidizes tobacco farmers, and legalizes and regulates the sale of tobacco, so why are the tobacco companies being sued? Shouldn’t it be the government that is held responsible?

A Joke........
I am a smoker and the truth is this. I don’t think she should get a penny of that money. And the reason i feel this way is because the tobacco company doesn’t force anyone to smoke. If your going to sue tobacco company why not sue evry company in the world. We can’t do anything without it causing some kind of health problems.

Tobacco Co's are liable, but what is the Govt Excise used for ?
Well I’m not a smoker; but easily could have been sucked in 30 years ago by both the advertising (then and later) PLUS the peer pressure from those that were sucked in.
The truth is this:- (1)tobacco had its place in Red Indian culture as a raw & natural herb for ceremonial and possibly medicinal use. It was used infrequently in not by all of the tribe (i.e. not usually squaws & children). (2) The tobacco Co’s are responsible for enticing smokers to smoke a grossly excessive amount (e.g. 20 a day / 40 a day) of an UNNATURAL concoction of poisons that includes tobacco. (3) Govt’s have been levying excise on tobacco for a long time and in ever increasing ratios. That was intended to not only try and put the lid on consumption (failed) but also to put money in the coffers for the inevitible MEDICAL problems but NOT for compensation. (4) The amount awarded in this case is grossly excessive; the woman is partly to blame and payouts should be capped no matter the staus of the recipient. (5) It is noted the honesty of

i started smoking at 6 years old and was never refused cigarettes by retailers in single or packs of 5, by 14 i was buying cigarettes from machines in the street, all the adverts gloryfied cigaretts as refreshing and trendy all the way through the 1960’s and through to the 1980’s, i gave up over 4 years ago, the corporations are responsible through their collective deceptions in adverts when their research said the opposite to good health was true, for this deception no amount of compensation is enough, they are more guilty than even the worst terrorist ativity, tabaco conglomrate must pay, and that means all those shareholders that have benefitted by billions od dollars for over 40 years since they knew of the fatal effects to citizens, a point in mention is that when the labour goverment was formed inthe uk in 1997 the prime minister said all smokers and former smokers would receive 1,000£ compenstation but this was never materiaised!
